Senator Romano moved to amend the bill on page three, section two, after line twenty-one, by adding the following:

§47-15-5. Criminal penalties.

(a)  A person who shall violate the provisions of this article shall be guilty of a misdemeanor, and, upon conviction thereof, shall be fined not less than three hundred nor more than $1,000, or confined in jail for a period not to exceed six months, or both.

(b) It shall be an affirmative defense to a prosecution under this section that the defendant did not receive more than 15 percent of the annual gross income he or she derived from the pyramid promotional scheme, from the recruitment of others.
